How do you reach a settlement with your employer?
There are only two ways to settle your complaints against your employer outside of an Employment Tribunal, one route is through ACAS (known as a 'COT3') and the other is a settlement agreement.

What is a Settlement Agreement?
A settlement agreement is a private and legally binding contract between you and your employer.
The employer will agree to make a payment to you, if you agree not to take or carry on with any legal action against them.
Most agreements have strict confidentiality clauses, which means that you cannot disclose the existence or terms of the agreement, apart from in certain limited circumstances.
An employer usually agrees to pay ‘contribution’ toward the cost of you getting advice from a Lawyer.
This type of agreement can only be valid if you have received legal advice from a Qualified Lawyer about the terms and effect of the settlement agreement.
When can you be offered a settlement agreement?
An agreement can be reached during, or even after employment.
You can be offered a settlement agreement at any stage – they are most common during disciplinary, performance or grievance procedures, or when you present your complaints to ACAS or the Employment Tribunal.
What should you do if you've been offered a settlement agreement?
It is essential that you receive specialist legal advice in order to make sure that you are being offered a fair payment, which depends on various factors such as: your contractual entitlement, the facts of your case, the strength of your claim and how much compensation you could be potentially awarded by an Employment Tribunal.
